Charging Reimbursement Credit. Subject to the terms and conditions of this Subscription, you will receive a monthly credit for the electricity cost of recharging your Vehicle (“Recharging Credit”). All other costs and expenses related to recharging your vehicle are excluded and will not be reimbursed or credited under this Subscription. Unless terminated earlier under this Subscription, the Recharging Credit will only be earned for the first 50,000 miles on the Vehicle during the Lease (“Recharging Credit Duration”).

Vehicle Information/Location Authorization. In order to be eligible for the Recharging Credit, you must enroll and maintain active service of the Hyundai Blue Link service, including agreement to the Connected Services Agreement Terms and Conditions (collectively, “Telematics Services”). The Recharging Credit will not begin to be earned until the Telematics Services is active for your Vehicle. Cancellation or termination of any portion of the Telematics Services at any time during the Recharging Credit Duration will terminate your eligibility to receive any remaining unused portion of the Recharging Credit. You also specifically consent to Lessor or its affiliates using the Blue Link service to obtain or receive information regarding the location and mileage of your vehicle at any time and for any reason. The mileage received from the Blue Link service will be used to calculate your Recharging Credit each month. Unless Lessor specifically agrees otherwise, such mileage through Blue Link will be conclusive for purposes of calculating your Recharging Credit. In the event that mileage cannot be accurately obtained through Blue Link, Lessor shall have sole discretion in selecting a substitute source for mileage, including requiring Lessee to submit documentation of the Vehicle’s mileage.

Calculation of Recharging Credit. The Recharging Credit will be calculated by multiplying the following items: (i) Monthly Mileage; (ii) the Vehicle’s kWh/Mile Rating; and (iii) California Cost/kWh. Monthly Mileage will be determined on a calendar month basis. The Vehicle’s kWh/Mile is 28.0 divided by 124.0. The California Cost/kWh will be the then in effect California Residential “Average Price of Electricity to Ultimate Customers by End-Use Sector, by State” as published by the U.S. Energy Information Administration in its Electric Power Monthly publication (including any superseding publications). In the event that such source is no longer available, the California Cost/kWh will be $0.186. The California Cost/kWh will apply even if Lessee or the Vehicle is no longer located in California. Lessee agrees that each of the above figures may not reflect Lessee’s actual mileage and costs.

Payment of Recharging Credit. The Recharging Credit will be a credit applied to your Lease account with Lessor. A credit will be applied to your Lease account on a monthly basis for the prior month’s earned Recharging Credit. Until the Recharging Credit is actually applied, you remain responsible for making the full monthly scheduled payment as set out in your Lease. In Lessor’s sole discretion, the Recharging Credit may be paid through the issuance of funds instead of an account credit.

Termination of Recharging Credit. The Recharging Credit will terminate if your Lease is terminated for any reason. Except for terminations due to your default, you will be entitled to receive any earned but uncredited/unpaid Recharging Credits up to the time of Lease termination. Such Recharging Credits will first be applied to any amounts still owing under the Lease. If your Lease termination is due to your default, you will not be entitled to earn any Recharging Credit not yet applied to your account. The Recharging Credit will terminate if your Lease account becomes 60 or more days delinquent, even if you subsequently cure such delinquency; and in such event, any Recharging Credits earned through 59 days of delinquency will be credited to your account pursuant to this Subscription.
